1. Introduction and Seller Information

By visiting our website and/or placing an order on our website, you agree to be bound by these Terms. These Terms comply with Belgian law (Code of Economic Law), EU Consumer Rights Directive 2011/83/EU, and all applicable EU regulations including the General Product Safety Regulation (GPSR) (EU) 2023/988.
2. Scope and Applicability
These Terms apply to all contracts concluded between us and consumers for the purchase of jewelry and related products via our online webshop. A "consumer" is any natural person acting outside their professional or commercial capacity.
We reserve the right to refuse orders at our sole discretion. We may update these Terms at any time; the version in force at the time of your order applies.
3. Products and Product Information
3.1 Product Descriptions
All jewelry on this website is handmade. Therefore, there may be slight variations in shape, colour, size or finishing. We make every effort to display our products as accurately as possible, including photographs, descriptions, materials, dimensions, and metal/gemstone specifications. However, slight variations in colour may occur due to screen calibration. The particular technical specifications and display settings of your device could affect the accuracy of how products appear; please pay close attention to the written descriptions and do not rely solely on photographs. Product descriptions are provided in good faith and are not warranties.
3.2 Product Safety – GPSR Compliance
All jewelry sold through our webshop complies with Regulation (EU) 2023/988 on General Product Safety (GPSR), effective 13 December 2024. Our products:
• Are free from prohibited substances (lead, cadmium, excessive nickel) in accordance with EU REACH Regulation (EC) 1907/2006
• Are accompanied by safety and traceability information as required
• Bear the CE marking where applicable
• Are sourced only from verified, compliant suppliers
We maintain full traceability records for all products in our supply chain. Consumers who identify a safety issue may contact us directly or report to the Belgian FPS Economy via ConsumerConnect (www.consumerconnect.be).
3.3 Precious Metals and Hallmarks
Any indication of metal purity (e.g., 925 sterling silver, 750 gold/18ct) is accurate to the best of our knowledge and supported by supplier certificates. Belgian law requires hallmarking of precious metal articles; our products comply with applicable requirements.
3.4 Availability
All orders are subject to availability. If a product becomes unavailable after your order is placed, we will notify you promptly and offer either an alternative product or a full refund.
4. Ordering Process
By placing an order, you confirm that you are at least 18 years of age or have parental/guardian consent. The ordering process is:
1. Select your product and add it to the cart.
2. Proceed to checkout and provide shipping and payment details.
3. Review your order summary before confirming.
4. Click "Order and Pay", this constitutes a binding order with payment obligation.
5. You will receive an order confirmation email. The contract is concluded upon our acceptance and dispatch confirmation.
We reserve the right to cancel orders in cases of pricing errors, suspected fraud, or stock unavailability. You will be notified immediately and fully refunded.
5. Prices and Payment
5.1 Prices
All prices displayed on our website are in Euros (€) and include Belgian VAT (BTW/TVA) at the applicable rate (currently 21% standard rate for jewelry). Shipping costs are displayed separately before checkout confirmation. All prices, discounts, and promotions are subject to change without notice; the price charged will be clearly stated in your order confirmation email. Price increases apply only to orders placed after the time of the increase.
5.2 Payment Methods
We accept the following payment methods Visa, Mastercard, American Express, Klarna. Payment is processed securely via Squarespace Payments. All transactions are encrypted using SSL/TLS technology.
6. Delivery
6.1 Delivery Times
We aim to dispatch orders within 15 to 30 business days. Estimated delivery times are: Belgium: 1–6 business days. These are estimates only and cannot be guaranteed. We are not liable for delays in shipment attributable to the carrier or events beyond our reasonable control.
6.2 Delivery Costs
Shipping costs are calculated and displayed at checkout before you confirm your order. Free shipping may be offered above certain order values; see our website for current promotions.
6.3 Risk and Title
Risk of loss or damage passes to you upon our transfer of the products to the carrier/delivery. Title to the goods passes upon full receipt of payment.
6.4 Failed Delivery
If delivery fails due to reasons attributable to you (wrong address, absent recipient), re-delivery costs may be charged. Unclaimed parcels returned to us will be refunded minus shipping costs after 14 days.
7. Right of Withdrawal (Cooling-Off Period)
In accordance with EU Directive 2011/83/EU and Belgian Book VI of the Code of Economic Law, you have the right to withdraw from your purchase within 14 calendar days without giving any reason.
7.1 Withdrawal Period
The 14-day withdrawal period begins on the day you (or a third party you designate, other than the carrier) take physical possession of the goods.
7.2 How to Exercise Your Right of Withdrawal
To exercise your right of withdrawal, you must inform us of your decision by an unequivocal statement (e.g., by email to info@maisonnoorbrussels.com) before the withdrawal period expires.
7.3 Exceptions to the Right of Withdrawal
The right of withdrawal does NOT apply to:
• Goods made to your specifications or clearly personalised (e.g., engraved jewelry, custom-made pieces)
• Goods which have been unsealed after delivery and cannot be returned for hygiene reasons (e.g., pierced earrings that have been worn)
7.4 Return of Goods
After notifying us of your withdrawal, you must return the goods within 14 calendar days. Goods must be returned in their original, unused condition, with all original packaging, tags, and documentation.
Return shipping costs are at your expense unless we have agreed to cover them or we failed to inform you of this obligation.
7.5 Refund After Withdrawal
We will reimburse all payments received from you, including standard delivery costs (but not additional costs if you chose a non-standard delivery method), without undue delay and no later than 14 days from the day we receive the returned goods or proof of return (whichever is earlier). Refunds will be made using the same payment method used for the original transaction.
We may withhold the refund until we have received the goods back or you have supplied evidence of having returned them. We may make a deduction from the refund if the goods show signs of use beyond what is necessary to inspect them.
8. Legal Guarantee of Conformity
As a consumer, you are entitled to a legal guarantee of conformity of 2 years from the date of delivery, in accordance with EU Directive 2019/771 and Belgian law. This guarantee covers:
• Goods that are defective, not as described, or not fit for their intended purpose
• Defects existing at the time of delivery that manifest within 2 years
In case of non-conformity, you are entitled to: (1) repair or replacement at no cost; or (2) if repair/replacement is impossible or disproportionate, a price reduction or full refund.
Please note: the legal guarantee is separate from and in addition to any commercial warranty we may offer. Normal wear and tear, damage caused by misuse, chemical exposure (perfumes, chlorine), or accidental damage are not covered.
9. Liability Limitations and Disclaimer
Nothing in these Terms limits our liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under applicable law (including the EU Product Liability Directive 2024/2853).
Subject to the above, our total liability to you in connection with any order shall not exceed the total price paid for the relevant order. We are not liable for:
• Indirect or consequential loss
• Loss of profit, revenue, or data
• Delay or failure to perform due to circumstances beyond our reasonable control (force majeure)
We make every effort to ensure the website operates without interruption, but we do not warrant that the website will be uninterrupted, error-free, or entirely secure, or that defects will always be corrected. The website is provided on an "as available" basis. We do not guarantee that the website or the server that makes it available are free of viruses or other harmful components.
We shall not be liable for any modification, suspension, or discontinuance of the website or any part thereof, whether with or without notice.
10. Indemnification
You agree to indemnify, defend, and hold harmless Maison Noor Brussels, and our directors, officers, employees, agents, contractors, service providers, and licensors from and against any and all claims, demands, losses, liabilities, damages, costs, and expenses (including reasonable legal fees) arising out of or relating to:
• Your breach of these Terms or any document incorporated herein by reference
• Your violation of any applicable law or the rights of any third party
• Any content, information, or submissions you provide to us or post on our website
• Your use of the website or any products purchased through it in an unlawful or unauthorised manner
This indemnification obligation shall survive the termination of these Terms and your use of our website.
11. Intellectual Property
All content on our website — including photographs, product descriptions, text, graphics, logos, icons, images, audio or video clips, articles, and design elements — is the property of Maison Noor Brussels or our licensors and is protected by Belgian and EU copyright law, trademark law, and other applicable intellectual property laws.
You are granted a limited, non-exclusive, non-transferable right to access and use the website as a customer. You may not:
• Reproduce, duplicate, copy, sell, resell, or exploit any portion of the website or its content for any commercial purpose without our express written permission
• Use any robot, spider, scraper, or other automated tool to monitor, extract, or copy website content
• Use our trademarks, logos, or trade dress without prior written authorisation
• Create derivative works from, reverse engineer, or decompile any technology used to operate the website
• Assist or encourage any third party to engage in any activity prohibited by these Terms
If you believe your intellectual property rights have been infringed by any content on our website, please notify us in writing at info@maisonbrussels.com, including: a description of the work claimed to be infringed; information sufficient to locate the material on our website; your contact details; a good-faith statement that the use is not authorised; and a statement, under penalty of applicable law, that the information provided is accurate and that you are the rights holder or authorised to act on their behalf.
12. Prohibited Uses
In addition to other prohibitions set out in these Terms, you are prohibited from using our website or its content:
• For any unlawful purpose or to solicit others to perform or participate in unlawful acts
• To violate any international, EU, Belgian, or other applicable laws, regulations, or ordinances
• To infringe upon or violate our intellectual property rights or the intellectual property rights of others

We reserve the right to terminate your access to the website immediately and without notice for any breach of these prohibited uses.

13.1 Licence to Use Submissions
By making a Submission, you grant Maison Noor Brussels a non-exclusive, royalty-free, perpetual, irrevocable, worldwide licence to use, reproduce, modify, adapt, publish, translate, distribute, and display that Submission in any medium and for any purpose connected with our business, including marketing and promotion. You waive any moral rights in the Submission to the extent permitted by Belgian law.
13.2 Your Responsibilities
You represent and warrant that:
• You have the full right, authority, and permission to submit the Submission
• The Submission does not infringe the intellectual property rights, privacy rights, or any other rights of any third party
• The Submission is not defamatory, threatening, obscene, pornographic, hateful, or otherwise unlawful
• The Submission does not contain any viruses, malware, or other harmful code
• If the Submission contains the image or likeness of any person, you have obtained their consent
13.3 Our Rights Regarding Submissions
We have no obligation to: (1) maintain any Submission in confidence; (2) pay compensation for any Submission; or (3) respond to any Submission. We reserve the right, at our sole discretion, to monitor, edit, remove, or refuse to publish any Submission that we determine to be unlawful, offensive, misleading, or in violation of these Terms, without prior notice and without liability to you.
You are solely responsible for the accuracy and content of any Submission you make. We accept no liability for any Submissions posted by you or any other third party.
14. Third-Party Links, Services, and Tools
Our website may contain links to third-party websites or offer access to third-party tools and services (for example, payment processors, social media platforms, or delivery tracking tools). These are provided for your convenience only.
We are not responsible for examining or evaluating the content, accuracy, practices, or policies of any third-party website or service. We do not warrant and shall have no liability or responsibility for any third-party materials, websites, products, or services. Any complaints, claims, or concerns regarding third-party products or services should be directed to the relevant third party.

15. Dispute Resolution and Applicable Law
15.1 Applicable Law
These Terms are governed by Belgian law. The UN Convention on Contracts for the International Sale of Goods (CISG) does not apply.
15.2 Alternative Dispute Resolution (ADR)
In accordance with EU Regulation 524/2013, disputes with online traders can be submitted to the EU Online Dispute Resolution (ODR) platform: https://ec.europa.eu/consumers/odr

15.3 Jurisdiction
In the event of a dispute that cannot be resolved amicably or through ADR, the courts of Brussels, Belgium shall have exclusive jurisdiction, without prejudice to any mandatory consumer protection jurisdiction rules under applicable EU law.
16. Miscellaneous
16.1 Severability
If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision shall be deemed severed from the remaining Terms, which shall remain in full force and effect to the maximum extent permitted by law.
16.2 Entire Agreement
These Terms, together with our Privacy Policy, Refund & Returns Policy, and any other policies published on our website, constitute the entire agreement between you and us with respect to your use of the website and purchase of our products, and supersede all prior agreements, representations, and understandings.
16.3 No Waiver
Our failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
16.4 Assignment
You may not transfer, assign, or otherwise dispose of your rights or obligations under these Terms without our prior written consent. We may transfer, assign, or sub-contract our rights and obligations under these Terms at any time, including in connection with a merger, acquisition, or sale of assets, provided that your consumer rights are not adversely affected.
16.5 Changes to These Terms
We reserve the right to update or replace these Terms at any time by posting the updated version on our website. The date of the most recent revision will be indicated at the top of the document.
